Rules of Arbitration
Where parties have agreed in writing to subject their disputes to the Arbitration and Mediation Center of the Chilean American Chamber of Commerce (hereinafterCenter), the arbitration shall take place in accordance with these rules, as in effect at the date of commencement of the arbitration proceeding, subject to whatevermodifications the parties may adopt in writing.

WIPO Arbitration Rules
These rules shall govern the arbitration, except that, where any of these Rules is in conflict with a provision of the law applicable to the arbitration from which the partiescannot derogate, that provision shall prevail. Where an Arbitration Agreement provides for arbitration under the WIPO Arbitration Rules, these Rules shall be deemed to form part of that Arbitration Agreement and the disputeshall be settled in accordance with these Rules, as in effect on the date of the commencementof the arbitration, unless the parties have agreed otherwise.

Hace poco tiempo atrás el Centro de Arbitraje y Mediación determinó necesaria larealización de un estudio o investigación en que se precisara con exactitud cual era lacreencia de los miembros de la comunidad legal acerca de las debilidades y fortalezas delsistema de arbitraje institucional y del CEAM Bio Bio como entidad prestadora de esteservicio. Asimismo, era necesario conocer la opinión de éstos respecto al presente y futurodel arbitraje en nuestra región, su necesidad de utilización y las desventajas que usarloconllevan.
