    I Index of Judicial Congestion in the Americas: Comparative Study of Judiciaries (2025)

    This report presents the first CEJA Index of Judicial Congestion in the Americas, offering a comparative assessment of judicial resolution and congestion across 13 Latin American judiciaries between 2018 and 2024. Using a quantitative and longitudinal methodology based on official judicial statistics, the study introduces standardized indicators to evaluate judicial performance, identify regional and national trends, and compare institutional capacity to resolve incoming cases while managing accumulated backlogs. The report also examines the relationship between judicial resolution and congestion and projects future scenarios through 2025 and 2030. The findings show that judicial congestion remains a structural challenge throughout Latin America despite two decades of judicial reforms. Most judicial systems continue to experience persistent case backlogs, limited improvements in resolution rates, and organizational models that constrain long-term efficiency. The study concludes that sustainable reductions in judicial congestion require structural transformation, including modern judicial management, institutional cultural change, stronger performance monitoring, digital transformation, and evidence-based public policies. It concludes with practical recommendations for judiciaries, ministries of justice, academia, and civil society aimed at improving judicial efficiency, transparency, and timely access to justice.

    Este informe presenta la evaluación realizada por el Centro de Estudios de Justicia de las Américas (CEJA), por encargo del Poder Judicial de Chile y de la Secretaría Técnica de Igualdad de Género y No Discriminación, sobre la implementación de la Ley N.º 21.675, que establece un marco integral para prevenir, sancionar y erradicar la violencia contra las mujeres en razón de su género. El estudio combina un análisis jurídico-dogmático de la normativa con una investigación cualitativa basada en entrevistas a jueces, funcionarios judiciales, Ministerio Público, Defensoría Penal Pública y otros actores del sistema de justicia. A partir de esta metodología, identifica los principales desafíos interpretativos, procedimentales e institucionales que han surgido durante el primer año de vigencia de la ley, poniendo especial énfasis en la incorporación de la perspectiva de género, la delimitación de competencias, la coordinación entre jurisdicciones y la protección efectiva de las víctimas.

    Indicators for Evaluating the Independence of Judges and Prosecutors in the Americas presents a methodological framework for assessing judicial and prosecutorial independence through a comprehensive system of qualitative and quantitative indicators. Developed by the Justice Studies Center of the Americas (JSCA), the publication translates international standards on judicial independence into measurable indicators that enable governments, judicial councils, prosecution services, oversight bodies, researchers, and international organizations to evaluate institutional performance using objective and verifiable evidence. The framework distinguishes between de jure, de facto, personal, and institutional dimensions of independence, providing technical definitions, units of measurement, and suggested verification sources for each indicator.

    I Índice de Congestión Judicial en las Américas. Estudio Comparado de Poderes Judiciales 2025

    El I Índice de Congestión Judicial en las Américas presenta un análisis comparado del desempeño de trece Poderes Judiciales de América Latina mediante el estudio de dos indicadores fundamentales: la Tasa de Resolución Judicial (TR) y la Tasa de Congestión Judicial (TC). A partir de un enfoque cuantitativo, longitudinal y comparado, la publicación examina la evolución de ambos indicadores durante el período 2018–2024, identifica tendencias regionales y nacionales, construye índices comparativos y propone estándares técnicos para evaluar la eficiencia y capacidad resolutiva de los sistemas judiciales. El estudio pone de relieve la estrecha relación entre la resolución de casos y la acumulación de causas pendientes, aportando evidencia para comprender uno de los principales desafíos estructurales de la administración de justicia en la región.
