Economic analysis provides a rigorous framework for evaluating the tradeoffs policymakers face when reforming legal institutions. Such analysis reveals that permitting private litigants to determine the amount and kinds of cases the courts hear can impose significant losses on society and shows how the social and private costs of accessing the justice system can be aligned. |
